Warned lawyers by the Norwegian Bar Association

The aim of Advokatguiden has always been to contribute to greater transparency in the Norwegian legal profession. With information provided by Advokatklageordningen, Advokatguiden has compiled the list below. It displays lawyers who have had three or more guilty verdicts against them, before the disciplinary authorities, in the last five years.

Criticism

Disciplinary action is an important offer extended to those who believe that a lawyer has taken too high a fee or has broken the rules of legal ethics. Complaints are free, and the action is funded by lawyers. The Bar Association's Disciplinary Committee is the first venue if the lawyer is a member of the Bar Association.

Reprimand

In the event of a breach of the Rules of Good Legal Practice, the Bar Association, Disciplinary Committee and the Disciplinary Council have three options for sanctioning, with increasing severity; criticism, reprimand and warning. In appeals concerning the size of the fee, the disciplinary bodies may also decide that the fee shall be reduced or waived alltogether. The lawyer can then be sentenced to repay all or part of the fee for complaints.

Warning

Decisions from committees can be appealed to the Disciplinary Council. The Disciplinary Council is also the first venue in appeal cases where the lawyer is not a member of the Norwegian Bar Association. The tribunal's decisions are final, but decisions can be brought before the court. The list below includes data from the Disciplinary Council and the Bar Association's disciplinary committee.

Criticism

Levied if the lawyer has acted in violation of good legal practice or in violation of law, cf. the Courts of Justice Act § 227.

Reprimand

Levied if the lawyer has acted in violation of good legal practice or in violation of law, cf. the Courts of Justice Act § 227, third paragraph.

Warning

Levied in serious cases in the event of a breach of good legal practice or law, cf. the Courts of Justice Act § 227, third paragraph.

Reduced fees

If the tribunal finds that a lawyer has demanded and excessive fee, it determines what is a reasonable and necessary feed, cf, the Courts of Justice Act § 227, fourth paragraph. The tribunal may order a lawyer who has received too high a fee to pay back the excess.
